The problem (and the code violation) is that you cannot disconnect the fixture from the source. By using a single pole switch there will always be voltage from the fixture to ground regardless on the switch position.

You must use a double pole switch. It meets code and it is safe. When the switch is off, the fixture is totally disconnected from the lines.
